Section 1 - Introduction

At PCS a Verisk Analytics business, we respect your privacy and value the trust and confidence you place in us. We are committed to safeguarding your privacy while you're using the PCS mobile application for iPhone and Android (referred to as the "App"). This Privacy Policy (referred to on this page as the "Policy") describes our commitment to your privacy. By using the App, you acknowledge that you understand and expressly agree to this Policy and the End User Licensing Agreement and that you have been presented the opportunity to opt in to PCS access of your device's camera for access to the full functionality of the App.

When you use the App, we may collect information about your visit to the App, your usage of the App, and information that you provide. This Policy describes:

· Information we collect from you and how we collect it (Section 2)

· How we use the information provided through the App (Section 3)

· With whom we share your information and your California privacy rights (Section 4)

· What security precautions we implement to protect the loss, misuse or alteration of your information (Section 5)

· Your rights and choices (Section 6)

· Data transfers (Section 7)

· How you can contact us regarding this Policy and our privacy practices (Section 8)

Please note that this Policy only addresses PCS privacy practices concerning information we collect from your use of the App, and not other sites or other mobile applications.

Please carefully read this Policy upon installation of the App on your mobile device.

A Note About Changes to This Policy

Please note that this Policy may change without special notice to you. Please check back to review this Policy whenever you visit the App as you will be deemed to have read, understood, received notice of, and agreed to any changes. This Policy supersedes all previous statements or policies concerning PCS' collection of personal information from the App.

The date of the last update to this Policy is always indicated near the top of the page and any change in the date of this Policy since the last time you had visited the App shall constitute notice to you that the Policy has changed since the last time you accessed the App. You may also see periodic statements displayed on the App notifying you that our Policy has changed. The last update to this Policy shall also be its effective date.

Section 2 - Information We Collect from You and How We Collect It

We collect information in several ways from several different parts of the App. The information we collect includes two basic kinds of data: (1) information collected to provide the services the App provides (2) information that we collect in order for the App to operate. We do not knowingly collect personal information from individuals under the age of 13.

We ask for and collect information in the following circumstances:

A. When You Download the App

When you download the App you are required to use your PCS ID to login.

B. When You Contact Us

If you contact PCS through the App, such as through our 'Help' function, you are referred to PCS support where we may keep a record of that correspondence which includes your e-mail address and any other information you provide to PCS in your correspondence.

C. When You Use App

When you take photos using the App we collect the image(s) captured as well as the city, state, peril and any details you provide when you manually type them into the "Media Information" section of the "Upload Media" component of the App.

Section 3 - How We Use The Information Provided Through the App

We may use the information that you provide or that we otherwise collect while you're using the App in the following ways:

· Operate, evaluate, and improve our business

· Develop new products and services

· Manage our communications

· Perform market research

· Analyze our products, services, and applications

· Administer the App

Section 4 - With Whom We Share Your Information and your California Privacy Rights

We do not sell or otherwise disclose information we collect on our App, except as described here. We may share information we collect on the App with affiliates and service providers that perform services on our behalf. We do not authorize those service providers to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. We may share information we collect through the App with our affiliates, which may use the information for marketing purposes.

In addition, we may disclose personal information about you (a) if we are required to do so by law or legal process (such as court order or subpoena), (b) to law enforcement authorities or other government officials, (c) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or (d) in connection with an investigation of suspected or actual fraudulent or illegal activity. We reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution, or liquidation). Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner consistent with this Policy.

Your California Privacy Rights

If you are a California consumer, upon your request (see Section 8 of this Policy entitled "Contacting Us Regarding This Policy"), we will disclose to you what personal information of yours was shared with our third party business partners within the immediately preceding calendar year (including disclosing to you our partners' names and addresses) if such information was used by our partners for their marketing purposes.

California Civil Code § 1798.83 also entitles residents of California to request information concerning with which third parties PCS has shared personal information in the immediately preceding calendar year for those third parties' direct marketing purposes. California residents may submit one request per calendar year in the form of a report that details: (a) what types of information PCS shared, (b) with whom PCS shared such information and (c) the nature of the third parties' businesses.

Reservation of Rights

We reserve the right to disclose personal information when we have reason to believe that disclosing this information is necessary to identify, contact, bring or defend against legal action involving someone who may be violating this Policy or who may be causing injury to or interference with (either intentionally or unintentionally) PCS' rights or property, other PCS users or anyone else who could be harmed by such activities. We may disclose or access account information for administrative or other purposes that we deem necessary to maintain or improve our products, services or the operation of the App, for law enforcement purposes, or when we believe in good faith that the law requires it.

Section 5 - What Security Precautions We Have in Place to Protect the Loss, Misuse or Alteration of Your Personal Information

We maintain administrative, technical, and physical safeguards designed to protect the personal information you provide against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use.

Section 6 - Your Rights and Choices

We offer you certain choices about how we communicate with you and what information we obtain from you. As required by applicable law, you may withdraw consent you previously provided to us. We will apply your preferences going forward. You may exercise these choices by advising us of your preference by e-mail or contacting us as specified in the "How to Contact Us" section below. You may also, at any time, object - on legitimate grounds and free of charge - to the processing of your personal information.

Subject to applicable law, you may have the right to request access to and receive information about the information we maintain about you, update and correct inaccuracies in your data, and have the information blocked or deleted, as appropriate. The right to access information may be limited in some circumstances by local law requirements.

You may contact us by email or post as described in the "How to Contact Us" section below to update your preferences or submit other requests.

Section 7 - Data Transfers

We may transfer the personal information we collect about you to recipients in countries other than the country in which the information originally was collected. Those countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer your information to recipients in other countries, we will protect that information as described in this Policy.
